Effective immediately, any non-fiction author who would like to apply for tax-exempt status for their books should do so at this time.
As you know, over the past several months, ARIA has been involved in a lawsuit against RI Taxation and the RI State Council on the Arts (RISCA) in an effort to bring the same tax-exempt status to non-fiction authors that fiction authors and other RI artists enjoy. Over the past few weeks, all three named plaintiffs in the suit (all non-fiction authors) received their official approvals and now have their tax exemptions in hand.
In order to apply for your exemption:
1. You must already be in possession of a permit to make sales at retail. If you do not have one, you can obtain one (for $10 per year) here: https://www.ri.gov/taxation/BAR/
2. To apply for the exemption, fill out and mail this form ASAP: https://risca.online/wp-content/uploads/2018/03/Artistic-Works-Sales-Tax-Exemption.pdf
3. If you were previously denied, file again.
4. After you have mailed this form, let me know by email authors@riauthors.org so we can keep track of how many of our authors take advantage of the opportunity.
5. If after you file, you are contacted by RI Taxation or if you are told there are restrictions on your permit (such as numbering and signing your books), let us know immediately.
6. And of course, if you are denied for any reason, we need to know that, too -- right away!
Our thanks go out to our attorney Lynette Labinger and the ACLU for their support in this endeavor. While this lawsuit is not yet over, we believe we are very close to achieving our goal.
Thank you!
